Privacy Policy

How your personal data is collected, used and protected when you contact us or visit this website.

Who is responsible for processing your data

Horacio Baptista Ladera, lawyer, practising in Lisbon, Porto and Funchal, is the controller of the personal data collected through this website. For any question regarding your data, you may contact us at info@baptistaladera.pt.

What data we collect

When you fill in the contact form, we collect your name, email address, telephone number (where provided) and the content of the message you send us. These are the only personal details the form asks for. If you accept analytics cookies, we also collect website usage data, described below.

For what purpose we use your data

The data collected through the form is used exclusively to respond to your consultation request and, should you become a client, to provide the legal services requested. We only use it for marketing purposes with your express consent, and under no circumstances do we sell it or transfer it to third parties for commercial purposes. Website usage data is used solely to produce statistics and improve the content.

Legal basis for processing

The processing of data collected through the contact form is based on your consent, given when you submit the form, and on the legitimate interest in responding to requests for information and consultation. Should you become a client, processing is also based on the performance of the contract for legal services and on compliance with the legal and professional obligations applicable to the legal profession. Analytics cookies depend on your consent, and the use of Google reCAPTCHA is based on the legitimate interest in protecting the website against abuse.

Cookies and visitor statistics

With your consent, the website uses Google Analytics 4, provided by Google Ireland Limited, to measure the number of visits, the pages viewed and how visitors reach the website. The analytics cookies (_ga and _ga_*) are only enabled after you click “Accept” in the cookie notice. If you decline, they remain disabled and the website works in exactly the same way.

The data is processed for statistical purposes, and Google Analytics 4 discards the IP addresses it collects. Your choice is stored in your own browser and can be changed at any time using the “Cookie preferences” link at the bottom of every page. When you withdraw consent, the analytics cookies are deleted.

Third-party services and data sharing

Data submitted through the contact form is processed through a form service (WPForms) and the website’s hosting server, both acting as processors within the meaning of data protection law. To protect the form against automated submissions, the website uses Google reCAPTCHA, which analyses technical data about your visit, such as your IP address, browser and interaction with the page, and may set a technical cookie.

The website’s typefaces are served from the website itself, without using Google Fonts. The map on the contact page, provided by Google Maps, only loads when you click “Show map”; from that point on, Google receives data such as your IP address and applies its own privacy rules.

If you prefer to contact us via WhatsApp, the conversation goes through the services of WhatsApp Ireland Limited, part of the Meta group, which are subject to that service’s privacy policy. Some of these providers may transfer data outside the European Economic Area, in particular to the United States, under the EU-US Data Privacy Framework or standard contractual clauses approved by the European Commission.

Data is shared with third parties only in the cases described in this policy and never for commercial or marketing purposes.

How long we keep your data

The contact details of those who do not become clients are kept only for as long as necessary to respond to the request, and are deleted thereafter. Client data is kept for the period required by the legal and professional obligations applicable to the practice of law in Portugal. Analytics cookies may last up to 2 years, unless you delete them sooner or withdraw your consent.

Your rights

Under Regulation (EU) 2016/679 (GDPR) and Portuguese Law No. 58/2019 of 8 August, you have the right to access your personal data, to rectify it, to request its erasure, to object to its processing, and to request restriction of processing and data portability, under the terms and within the limits provided by law. Where processing is based on consent, you may withdraw it at any time, without affecting the lawfulness of processing carried out before then. You may exercise these rights by contacting us at the email address given above.

You also have the right to lodge a complaint with the Comissão Nacional de Proteção de Dados (CNPD), the Portuguese supervisory authority for the purposes of the GDPR and Law No. 58/2019, if you consider that the processing of your data does not comply with the applicable law.

Changes to this policy

This policy may be updated periodically to reflect legal changes or changes to how the website operates. The date at the top of this page indicates the most recent update.
